Vamos a examinar los orígenes de este famoso cazador de dictadores a escala planetaria recordando el proceso seguido contra Pinochet.

21 de septiembre 1998 Augusto Pinochet, senador vitalicio de Chile, sale del país con pasaporte diplomático; luego de algunos días en Brasil, llega a Gran Bretaña. Sufre una seria dolencia en la espalda. 13 de octubre: la justicia de España comunica a las autoridades británicas que desea tomar declaración a Pinochet sobre casos de desaparecidos españoles durante el gobierno militar de Chile. 16 de octubre: el juez español Baltasar Garzón emite la orden internacional de búsqueda y captura de Pinochet a través de la Interpol. Agentes de Scotland Yard comunican al general retirado su detención preventiva. Pinochet se encontraba en la London Clinic, recuperándose de su operación. 28 de octubre: la Corte Superior de Londres dictamina que Pinochet goza de inmunidad soberana en su calidad de ex-jefe de Estado, y declara ilegal su detención. El asunto pasa a la Cámara de los Lores. 30 de octubre: la Sala de lo Penal de la Audiencia Nacional de España determina que los tribunales del país eran competentes para investigar los crímenes cometidos durante el gobierno militar de Chile. Los jueces británicos conceden a Pinochet un régimen de libertad restringida. 25 de noviembre: la Comisión Jurídica de la Cámara de los Lores decide que el Gral. (r) Augusto Pinochet deberá permanecer en Gran Bretaña para someterse a la justicia. La decisión del tribunal de última instancia de Gran Bretaña fue por tres votos contra dos. 9 de diciembre: el ministro del Interior de Gran Bretaña, Jack Straw, autoriza que se inicie el proceso de extradición del ex gobernante de facto de Chile, Augusto Pinochet, a España. La decisión final queda ahora en manos de los tribunales británicos. Pinochet se debe presentar el viernes 11 de diciembre ante el tribunal de Belmarsh, en el sureste de Londres para la vista preliminar del caso. El gobierno de Chile llama a su embajador en Londres, Mario Artaza, con carácter de urgencia. 15 de febrero. Organizaciones civiles de chilenos se hacen parte del juicio contra Pinochet. Se incorpora como abogado Reed Brody.
24 de marzo de 1999: la Comisión Jurídica de la Cámara de los Lores británica resuelve, por 6 votos a 1, que el Augusto Pinochet no goza de inmunidad soberana desde septiembre de 1988, momento en el que Gran Bretaña ratifica la convención internacional contra la tortura. A pesar de la radical reducción de los cargos en contra del general, puede continuar el proceso de extradición. El caso vuelve a manos del ministro británico del interior, Jack Straw. 23 de septiembre: Pinochet pasa 20 minutos en un hospital donde es sometido a exámenes médicos. 2 de noviembre: paralelamente a este caso, el juez Baltasar Garzón ordena la busca y captura de 98 argentinos, entre ellos los ex presidentes Jorge Rafael Videla y Leopoldo Fortunato Galtieri, para pedir su extradición y juzgarlos por los delitos de genocidio y torturas. 5 de enero de 2000. Pinochet ingresa a un hospital de Londres para ser examinado por médicos independientes y determinar si está o no en condiciones de ser extraditado a España. 11 de febrero: partidarios de Augusto Pinochet informan de una descompensación general de la salud del general en retiro. 2 de marzo: El ministro del Interior británico, Jack Straw, libera a Pinochet por razones de salud. Straw basó su decisión en un informe médico que señala que el ex-gobernante de facto no está en condiciones de afrontar un juicio. El general inicia su regreso a Chile a bordo de un avión de la Fuerza Aérea Chilena. 10 de diciembre de 2006. Muere Pinochet en Chile. Años más tarde se descubrió su inmensa fortuna proveniente de la corrupción y del delito. Esta corta narrativa solo persigue recordarles a nuestros amables lectores que los delitos de «lesa humanidad» no prescriben y son perseguibles por cualquiera autoridad policial y judicial en cualquier lugar del mundo. Sobre esa base se han desarrollado personalidades y organizaciones especialistas en la búsqueda y castigo de todos los dictadores del mundo. Es allí donde Reed Brody muestra sus garras, su empeño, su compromiso. Es incansable este abogado norteamericano. Repasemos algunas de las informaciones más relevantes de su historia y su trabajo. Nació en Brooklyn en 1.953. Abogado. Consejero Jurídico y portavoz de la Human Rights Watch. Es el perseguidor por antonomasia de los líderes políticos responsables de delitos contra la humanidad. Judío, de origen húngaro. Bachelor of Arts en Ciencias Políticas en Fairleigh Dickinson y licenciado en Derecho de la Universidad de Columbia. Asistente del Fiscal General del Estado de Nueva York, allí se especializó en defensa de los derechos de los consumidores y trabajadores y en la lucha contra las malas prácticas de instituciones financieras y corporaciones. Fue perseguidor de los Contras en Nicaragua por los numerosos abusos cometidos por estos «colectivos» paramilitares. Esto demostró su total independencia de los grupos de derecha o de izquierda. Su primera gran victoria fue llevar a juicio en Dakar, capital de Senegal y lograr una condena a cadena perpetua del dictador del Chad Hisséne Habré. Trabajó igualmente al lado de las víctimas de la dictadura de Augusto Pinochet contribuyendo a lograr la extradición a Chile del anciano dictador. Participó activamente en favor de las víctimas de los genocidas del grupo Duvalier, particularmente contra el haitiano Jean-Claude Duvalier conocido como Baby Doc. Jean-Claude se salvó del juicio y condena con su muerte en el 2014. Antes de unirse a Human Rights Watch, Brody encabezó equipos de la ONU que investigaban las matanzas en la República Democrática del Congo y observaban los derechos humanos en El Salvador. Su labor es incansable y de una tenacidad admirable. Una vez que fija el objetivo no abandona la lucha hasta lograr el juicio y la encarcelación del dictador. Igualmente tuvo destacada participación en los procesos judiciales contra el ugandés Idi Amin, el etíope Mengistu
y los culpables de las matanzas del Tíbet. Entre sus frases más famosas encontramos «Cuando a finales de los noventa los lores británicos dijeron que un dictador podía ser juzgado en cualquier lugar del mundo por violaciones de los Derechos Humanos hubo una especie de efervescencia en el mundo de la justicia internacional para llevar ante los tribunales a quienes parecía que estaban lejos del alcance de la Ley. Podíamos soñar». Tras trabajar en la Comisión Internacional de Juristas defendiendo por todo el mundo a abogados y jueces perseguidos, su cruzada por los Derechos Humanos le llevó a El Salvador, Guatemala, Tíbet, Haití, Timor del Este y la República Democrática del Congo. Dice Brody «El problema es que no todos los dictadores ni gobernantes del mundo que han cometido crímenes de guerra se sentarán en el banquillo. «Personalmente me gustaría que el próximo Habré fuera George W. Bush, que se le juzgara por las torturas, las prisiones secretas, Guantánamo. Aunque aún estamos muy lejos de que existan las condiciones políticas para ello, lo cierto es que no se ha dicho la última palabra, de hecho, Bush ha dejado de viajar» «No siempre salimos victoriosos. Recuerdo que el ex dictador etíope Mengistu, que vivía en Zimbabue, viajó a Sudáfrica por un tema de salud y aprovechamos para poner una demanda en este país, pero no prosperó. Igual ocurrió con Izzat Al Duri, el brazo derecho de Sadam Hussein, quien viajó a Viena por cuestiones de salud en 1999 pero el Gobierno de Austria le permitió salir del país» Hasta ahora la Corte Penal Internacional, en cuya creación participó el propio Brody, sólo ha abierto procesos contra dictadores africanos. La pregunta sobre qué debemos hacernos los venezolanos y sobre todo a qué pueden enfrentarse en el futuro los jerarcas del gobierno, desde el número uno y su consorte hasta los miembros del TSJ y del CNE depende en buena parte si Brody tendrá algún interés en perseguir implacablemente a algunos de los dictadores de América Latina y también sobre la disposición del Gobierno, el TSJ, el CNE y la cúpula militar a cumplir las exigencias constitucionales. Mientras tanto el mapa de Venezuela se tiñe de sangre. Los muchachos caen baleados por los colectivos. El ruido de la muerte ensordece los oídos de la libertad.
